Terms of Service

1. Acceptance of Terms

By accessing or using Legal-Plot ("the Service"), operated by Valley Land Surveying PLLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Services

Legal-Plot is a SaaS platform that provides automated processing of legal descriptions, mapping, and geospatial outputs. The Service includes parsing, closure analysis, map visualization, DXF/KML/GeoJSON export, and related tools. Outputs are computational approximations and are not a substitute for professional judgment or a licensed land survey.

3. Accounts and Registration

You must create an account to access the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and promptly update it if it changes. You must be at least 18 years old to use the Service.

4. Credits and Payments

Access to certain features requires purchasing credits. Credits are purchased through our payment processor (Stripe) and are non-refundable except as required by applicable law. Credits do not expire but have no cash value and are not transferable. One credit is consumed per successful legal description processing operation. We reserve the right to change pricing with reasonable notice.

5. Surveying and Boundary Disclaimer

Output produced by Legal-Plot does not constitute a licensed land survey and shall not be used to establish, relocate, or certify property boundaries. All output is for professional reference and workflow assistance only. Valley Land Surveying PLLC makes no representations regarding the positional accuracy of PLSS corner coordinates, GCDB point data, BLM CadNSDI records, or any other government reference dataset used by the Service. Users are solely responsible for verifying output against original source documents and applicable survey standards before relying on any result for legal, regulatory, title, or conveyancing purposes.

Users are solely responsible for:

  • Verifying all results independently
  • Compliance with applicable surveying laws and regulations
  • Use of outputs in legal, engineering, or conveyancing contexts

6. Legal Description Risk and Input Quality

Legal descriptions may be ambiguous, internally conflicting, incomplete, or dependent on historical monuments that cannot be computationally resolved. The accuracy and completeness of all output is entirely dependent on the quality and clarity of the input provided. Valley Land Surveying PLLC does not warrant that any given description will parse completely or correctly. Users are responsible for reviewing output for errors, unclosed traverses, missing calls, and any discrepancy between the plotted linework and the intent of the original document.

7. Automated Processing and AI Disclosure

Legal-Plot uses automated parsing, computational geometry, and AI-assisted inference to interpret legal descriptions. The Service may make assumptions to produce output, including but not limited to: inferring the Point of Beginning from PLSS corner data, inferring an implied Basis of Bearings from PLSS inverse calculations, skipping unrecognized calls, and estimating curve parameters from incomplete data. These assumptions are disclosed in the processing log associated with each result. Users must review all assumptions before relying on any output. Automated results are not a substitute for professional judgment.

8. API Access and Credit Usage

API access to the Service is governed by these Terms. Each successful legal description processing event — whether submitted through the web interface or via API — consumes one credit from your account balance. Credits are deducted at the time of successful processing. Failed or rejected requests due to malformed input or server error do not consume credits. We reserve the right to implement rate limiting, throttling, or access restrictions on accounts that exhibit abnormal usage patterns, automated abuse, or attempts to extract reference data at scale. Programmatic access that circumvents rate limits or monetization controls is prohibited and may result in immediate account termination without refund.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload unlawful, restricted, or infringing data
  • Attempt to reverse-engineer or extract proprietary data or algorithms from the Service
  • Submit content that infringes any third-party intellectual property rights
  • Attempt to gain unauthorized access to any portion of the Service or its related systems
  • Use automated tools to abuse the Service beyond normal usage patterns
  • Resell or sublicense access to the Service without written permission

10. Intellectual Property

The platform, software, algorithms, reference data, and content are owned by Valley Land Surveying PLLC and protected by applicable intellectual property laws. You retain ownership of the legal description text and documents you submit. Output files (DXF, KML, GeoJSON, PDF) generated from your input are yours to use. You grant us a limited license to process your input solely to provide the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUT WILL BE SUITABLE FOR USE IN ANY LEGAL, REGULATORY, OR PROFESSIONAL PROCEEDING. OUTPUT FROM THE SERVICE IS NOT A SUBSTITUTE FOR A LICENSED LAND SURVEY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VALLEY LAND SURVEYING PLLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE OR ITS OUTPUTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Valley Land Surveying PLLC and its officers, employees, and agents from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your reliance on or use of any output generated by the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason with reasonable notice. You may cancel your account at any time through your account settings. Unused credits are non-refundable upon termination unless required by applicable law.

15. Changes to Terms

We may modify these Terms at any time. We will notify you by email or by posting a notice on the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction in Ada County, Idaho.
